L' Ordre des avocats n'est pas sortie de la crise.
On croyait, au sortir de l’Assemblée générale organisée le 04 novembre dernier, à la fin de la chienlit au sein de l’Ordre des avocats. Il n’en est rien. Quelques heures seulement après la réinstallation de Me Lubin Ntoutoume, ancien bâtonnier, à la tête de cet ordre, son confrère, Jean-Paul Moumbembé dénonçait ce qu’il va qualifier de « coup d’Etat ordinal ». Allez y comprendre. Dans une publication postée sur sa page Facebook, Moumbembé indique être en attente de la décision du Conseil d’Etat à la suite d’une nouvelle saisine en contestation.
Une démarche totalement incompréhensible pour les membres de l’Ordre des avocats ayant pris part à l’Assemblée générale actant le retour de Me Lubin Ntoutoume. Ces derniers rappellent qu’il ne s’agit pas d’un nouveau mandat, mais de la gestion des affaires courantes et de l’organisation d’une nouvelle élection par le bâtonnier.
Une décision conforme à l’article 59 alinéas 2 de la loi sur la profession d’Avocat. « Ayant fait le choix d’éviter toute forme de compromis et d’arrangement d’arrière-boutique, l’Assemblée générale de ce mois de novembre aura décidé de s’en référer à la loi. Ce, dans le but de parvenir à établir un climat apaisé au sein de l’organisation qui pâtit d’une guerre sans fin entre ses membres », souligne un membre de l’ordre.
Sauf que les membres de cette organisation ont, depuis longtemps, arrêté de regarder dans la même direction. Préférant bloquer le fonctionnement de l’organisation pour leurs egos personnels. Ce qui explique, qu’à l’époque ministre de la Justice, Erlyne Antonela Ndembet Damas avait, avec un groupe d’avocats acquis à sa cause, refusé catégoriquement l’option de désigner le bâtonnier sortant pour gérer les affaires courantes.
Conséquence de ce désordre organisé, le Gabon est donc dépourvu, jusqu’à ce jour, d’une entité qui assure au quotidien la régulation et l’autorégulation de l’activité d’avocat. A l’extérieur, notre pays n’est plus représenté dans des instances comme l’Union internationale des avocats, alors qu’il y a encore quelques mois, sous la férule du bâtonnier sortant Me Lubin Martial Ntoutoume, le Gabon a abrité le 35e congrès annuel de la conférence internationale des barreaux (CIB).
