Le Collectif d'habitants d'IYala.
Le gouvernement a décidé de retirer les titres fonciers à plusieurs SI dont Titane Construction SA. Soulagées par cette décision, les populations d'Iyala, à Malibé 2, dans le 1er arrondissement de la commune d'Akanda ont apporté leur soutien au gouvernement au cours d'une conférence de presse tenue samedi dernier à Iyala.

Les populations d'Iyala sont menacées d'être déguerpis de la parcelle n°01/Y03 par Titane Construction SA, une société immobilière. Pour attirer l'attention des plus hautes autorités sur la menace qui pèse sur eux, les habitants de cette partie du grand Libreville ont organisé une conférence de presse samedi dernier. Cette énième sortie avait pour objectif de soutenir le gouvernement qui a décidé de retirer à certaines SI, dont Titane Construction, les titres fonciers dont les dossiers présentent de nombreuses irrégularités.
« Conscients des procédures et réglementation en vigueur en matière de foncier et d’urbanisme, nous nous sommes individuellement rapprochés des différentes administrations en charge de la régularisation foncière avant la création en 2012 de l’Agence nationale de l’urbanisme des travaux topographiques et du cadastre (ANUTTC) », a indiqué le collectif.
Avant d’ajouter : « Pour certains parmi nous, les procédures ont régulièrement suivi leur cours jusqu’au moment où lesdites procédures ont été bloquées pour des raisons jusqu’ici inconnues. »
En effet, c'est plus d'une centaine de familles gabonaises qui sont actuellement menacées d'expulsion par cette société immobilière laquelle se prévaut d’être propriétaire de la parcelle n° 01/Y03 du plan cadastral d’Akanda qui couvre une superficie de 3 004 254 m². Sauf que les habitants remettent ouvertement en cause les documents que cette société anonyme présente pour prouver qu’elle est propriétaire de la parcelle n° 01/Y03.
Pour rappel, « En 2014, Titane constructions a fait la demande de la réservation foncière. Mais curieusement, le jour que la demande a été faite, c’est aussi le même jour que la décision d’attribution de la réservation a été accordée, alors que la loi gabonaise indique que pour les promoteurs, il faut trois ans pour valoriser un site », déclare, dépité, l’un des membres du collectif des habitants d’Iyalala.
« Pire, poursuivent les habitants d’Iyalala, nous avons déniché plusieurs cas de fraude dans la procédure d'attribution de la parcelle n° 01/Y03. Notamment la violation flagrante des formalités substantielles de publicité prévues par le décret n° 257/PR/MECIT du 19 juin 2012 réglementant les cessions et locations des terres domaniales.

Le défaut de personnalité juridique et encore moins d’une capacité juridique de son représentant lui permettant également d’être titulaire de droits ». Conséquence, en août 2020, les habitants et certaines sociétés immobilières en possession des titres fonciers sur la parcelle querellée vont attaquer la décision cédant la parcelle à la société Titane Constructions devant les tribunaux. C’est ainsi que sur la base des irrégularités mentionnées, le mardi 11 août 2020, la société Titane Constructions a été déboutée par le Tribunal administratif de Libreville en annulant la décision n° 0001828 du 14 août 2014 portant cession en toute propriété à ladite société de la parcelle querellée.
Présentation d’un titre foncier frauduleusement obtenu
Alors que la décision d’attribution est frappée de nullité, Titane Constructions va refaire surface en brandissant un titre foncier signé le 21 février 2021. Incroyable mais vrai ! Comment cette société a-t-elle pu se procurer un titre foncier, alors que, quelques mois avant, elle a été déboutée devant le Tribunal administratif ? Pas besoin d’être un clerc pour se rendre compte du caractère frauduleux du titre foncier. C’est du moins l’avis des habitants qui indiquent que ce document ne repose sur aucune base légale. « Ils nous ont brandi un titre foncier, mais ils ont curieusement refusé de nous présenter un dossier complet pouvant justifier l'authenticité du fameux titre foncier.
Pour voir clair, nous avons fait recours aux topographes qui se sont mobilisés durant toute une journée sur le site, à la recherche des bornes. Mais aucune des 15 bornes indiquées n’a été identifiée », renchérit un autre membre du collectif des habitants d’Iyalala. Ayant déjà procédé à plusieurs investissements, les habitants d’Iyalala, dont certains sont autochtones, ne comptent pas se laisser intimider. Ils promettent d’employer tous les moyens pour conserver leurs biens.
