Kongo Yoanis, c’est son nom, n’est plus un lieutenant de la Garde Républicaine. L’ex aide camp de Brice Laccruche Alihanga vient d’être reversé à la Sécurité pénitentiaire à la suite d’un décret signé par le président de la République, Brice Clotaire Oligui Nguema en date du 8 janvier dernier. Le même décret indique que le concerné conserve son grade de Lieutenant, son poste budgétaire et son ancienneté dans son nouveau corps d’affectation.
Si dans le milieu militaire cette décision étonne plus d’un, certaines sources indiquent qu’elle a été motivée par la volonté d’écarter l’ancien aide camp de l’ex directeur de cabinet d’Ali Bongo des affaires. Pourtant ce proche de Brice Laccruche Alihanga avait été quasiment disculpé des délits de « concussion » et de blanchiment de capitaux ».
Lors de ce procès, l’ancien officier de la GR n’avait cessé de clamer son innocence en indiquant devant le juge : « Je n’ai fait qu’obéir aux ordres ». Pour avoir exécuté l’ordre qui consistait à aller récupérer de l’argent au Trésor public et à le redistribuer à de nombreuses personnalités politiques, Yoanis Kongo risquait dix ans de prison et 200 millions de Fcfa d’amende.
Sauf, qu’au regard de la manière dont les débats avaient été menés, tout laissait penser qu’il y avait une volonté derrière d’inculper l’aide camp pour faire tomber son ancien chef. Ce qui explique, par exemple, qu’en aucun moment de ce procès, le juge n’avait daigné convoquer à la barre toutes les personnalités politiques (Premier ministre, Ministres, Directeurs généraux…) qui se seraient rendus complices du délit de recel. Etant donné que la justice avait établi que l’argent, qui était redistribué par l’aide de camp de BLA, était le fruit de détournements de fonds.
Les magistrats n’avaient non plus trouvé pertinent de convoquer à la barre Franck Yann Koubdje, l’ex Directeur général du Trésor public, qui avait autorisé le décaissement des fonds. Il était plus simple, pour les juges et la partie civile, d’évoquer l’impossibilité pour Yoanis Kongo de s’acheter trois voitures et de construire une maison à Angondje avec un salaire d’officier de 715 mille Fcfa. Et qu’à cet effet, les 45 millions de Fcfa qu’il percevait par trimestre au titre des primes se faisaient en toute illégalité.
Pourtant, il n’y avait rien de nouveau sous le soleil. Puisque le jeune officier n’a fait que bénéficier d’un mécanisme qu’il avait trouvé en devenant l’aide de camp du Directeur de cabinet du Président de la République. Fallait-il le condamner pour cela sans avoir à questionner la responsabilité de ceux qui ont mis en place ce mécanisme de prédation des fonds publics ? Là aussi, les juges et la partie civile ont préféré se défausser, en évitant non seulement d’aborder un débat de fond, mais encore et surtout d’interroger la responsabilité du Président de la République de l’époque et de l’ensemble de la chaine de commandement dans une affaire qui démontre à quel point l’argent public était dilapidé.
C’est d’ailleurs, à juste titre, que Me Gomez, l’avocat de Kongo, s’était interrogé sur le fait que toutes les personnes qui percevaient ces primes n'avaient pas été arrêtées. « Cette justice sélective ne nous grandit pas ! », avait rajouté Me Maguisset sur ce dossier.
