Les travaux du marché de franceville toujours à l'arrêt.
Les travaux sont arrêtés depuis quasiment deux ans. Les commerçants, qui espéraient voir le bâtiment être livré en 2023, déchantent désormais. Malversations financières, surfacturations et opacité dans l’octroi de cet important chantier… Le marché de Franceville n’est toujours pas livré. Le propriétaire de l’entreprise en charge des travaux vient d’être placé sous mandat de dépôt. Enquête.
C’est désormais la panique dans le monde du BTP au Gabon. Plusieurs opérateurs économiques qui ont profité des complicités du régime déchu d’Ali Bongo pour arnaquer l’Etat gabonais tombent, les uns après les autres, dans les mailles de la justice. Le dernier cas en date, celui d’Abdoul Houssein Moussavou, cet opérateur économique a été placé sous mandat de dépôt le vendredi 22 septembre dernier. Cet homme d’affaires qui a acquis la nationalité gabonaise est poursuivi pour association de malfaiteurs, inexécution de marché public et blanchiment de capitaux. « Sans expérience, il a obtenu un chantier de construction du marché de Franceville pour un coût allant jusqu’à 4 milliards de francs CFA (environ 6 millions d'euros) alors que ses concurrents demandaient 900 millions de francs CFA (approximativement 1,3 million d'euros). » souligne à cet effet, Jeune Afrique.
Retour sur les conditions de ces malversations
En 2017, un contrat des travaux de reconstruction du marché central de Franceville avait été établi entre la présidence de la République gabonaise et l’entreprise Bativert International. Montant du contrat, 4 milliards 456 millions 076 mille 025 Fcfa hors-taxe. Jusqu’ici, tout va bien. Sauf que le 23 juin 2020, deux mois quasiment après le décès, dans des conditions troubles, d’Alexis Ndouna, un des promoteurs de l’entreprise Bativert International, l’Etat gabonais, résilie ledit contrat au motif de l’incapacité du titulaire du marché à continuer les travaux arrêtés depuis décembre 2019.
Compte tenu de l’importance du marché pour Ali Bongo Ondimba, une mission du ministère des Travaux publics séjourne à Franceville du 24 au 28 janvier 2020. Ce, afin de procéder à une évaluation des travaux restants de la construction du marché. Le coût du chantier est estimé à 1 milliard 204 millions 577 mille 306 Fcfa. Le 16 juin 2020, le ministère des Travaux publics lance un appel d’offres restreint avec les entreprises Zein BTP, EGACO et SOCOBA EDTP. Le 20 juillet 2020, la Commission d’Evaluation des offres (CEO) procède à l’ouverture des plis relatifs à l’appel d’offres restreint lancé le 1er juillet 2020.
Le rapport de la Commission d’Evaluation des offres précise ce qui suit : en examen préliminaire, la CEO a rejeté l’offre de SOCOBA EDTPL pour élément non-conforme et va juger irrecevable l’offre technique de la société EGACO. Curieusement, alors que la commission estime infructueuse l’appel d’offres, c’est l’entreprise Zein BTP avec à sa tête Abdoul Houssein Moussavou qui va obtenir le marché, par entente directe avec l’Etat gabonais, pour un montant global de 3 milliard 083 millions 034 mille 297 Fcfa. Soit 1 milliard 400 millions de Fcfa de plus que le montant des travaux établi par la Commission du ministère des Travaux publics et même des autres offres.
Y-a-t-il eu une surfacturation du marché ?
Pour les membres de la Task-force, qui ont mission d’investiguer sur ce dossier, il n’y a pas de doute. Immédiatement, la Task-force conduite par Pierre Duro, après les premières auditions et le recoupage des éléments du dossier, découvre que l’ancien ministre des Travaux publics, Léon Armel Bounda Balonzi a, volontairement, écarté la direction générale de la construction et de l’équipement dans le marché d’entente directe avec Zein BTP. Pire, la direction générale de la construction et de l’équipement n’aura même pas la possibilité d’analyser l’offre financière de l’entreprise Zein BTP qui, pourtant, paraissait anormalement élevée. Comment expliquer les agissements de l’ancien ministre des Travaux publics ? Bounda Balonzi a-t-il reçu une rétrocommission pour privilégier de signer un contrat par entente directe avec une entreprise dont le montant des travaux était quasiment le triple de l’évaluation faite par ses propres services ?
Les révélations d’un ancien secrétaire général du ministère des Travaux publics le confirment. Ce dernier, d’après une source proche de Bounda Balonzi, aurait, clairement, avoué lors de son audition par la Task-force, que l’ancien ministre avait écarté le Secrétariat général du ministère dans le traitement de ce dossier. « L’opération de finition des travaux du marché central de Franceville a fait l’objet d’une instruction verbale de Monsieur le ministre des Travaux publics, Bounda Balonzi. (…) Il m’avait été instruit de confier le marché par entente directe. J’avais sollicité l’avis de non-objection des marchés publics garant de la procédure de passation des marchés. Le courrier avait été préparé par les services du cabinet du ministre. Ne pouvant pas m’opposer, je me suis astreint aux instructions ».
