Le 15 janvier dernier, Top Infos Gabon publiait un article intitulé : « Election à la Chambre de commerce : les organisations patronales dénoncent les manigances des collaborateurs du Premier ministre ». Se sentant attaqué par un article qu’il juge diffamatoire, le directeur de cabinet du premier Ministre, Jean Minko, vient de nous faire parvenir sa mise au point que nous publions telle que reçue.
Contexte :
Une frange de compatriotes regroupés dans une plateforme syndicale patronale dont la part reste à démontrer dans la création de la richesse nationale, s’illustre depuis un certain temps, à travers le média en ligne TOP INFOS, avec leur pigiste de service BITOLI Valérie, dans l’invective, la calomnie et la diffamation à l’endroit du Premier Ministre Chef du Gouvernement de la Transition et de son Directeur de Cabinet, relativement au dossier du renouvellement de la Chambre de Commerce, d’Agriculture, d’Industrie, des Mines et de l’Artisanat du Gabon.
Le coup de liberté ayant porté les forces de défense et de sécurité regroupés au sein du CTRI n’a guère consacré l’incivisme, la diffamation et les outrages en tout genre à l’endroit des dépositaires de l’autorité de l’Etat, mais au contraire, il est venu restaurer l’état de droit, le civisme, l’autorité de l’Etat et la protection des droits fondamentaux des citoyens.
Les outrages professés par les membres de la plateforme syndicale patronale, relayés dernièrement par Radio Gabon dans sa revue de presse du 31 janvier 2024, exposent bien entendu leurs auteurs à la répression prévue par les dispositions du Code pénal, assortie des condamnations en dommages et intérêts
Problématique :
De quoi s’agit-il ?
Une administration provisoire mise en place courant 2010 (arrêté n°01144/PM du 30 novembre 2010) avait procédé aux élections des membres et du Bureau de la Chambre de Commerce. Les membres élus furent installés en février 2011, pour un mandat de quatre ans. Un mandat qui, en principe s’est achevé, en 2015. Mais force est de constatée qu’aucune élection n’est intervenue depuis neuf (9) ans. La fameuse plateforme n’est curieusement pas montée au créneau pour revendiquer le renouvellement des membres et le Bureau de la Chambre de Commerce.
Discussion :
Le décret n° 0728 du 21 juin 2011 qui consacre la Chambre de Commerce, d’Agriculture, d’Industrie, des Mines et de l’Artisanat du Gabon, organisme professionnel de protection des intérêts des opérateurs économiques, comme un établissement public à caractère professionnel, placé sous la tutelle du Ministre de l’Economie, prévoit pourtant dans son chapitre IV tout le dispositif électoral. Mais les différents gouvernements qui se sont succédés depuis 2011 n’ont opportunément pas organisé les élections de renouvellement de la Chambre de Commerce, d’Agriculture, d’Industrie, des Mines et de l’Artisanat du Gabon.
Notons au passage, qu’une Chambre des métiers et de l’Artisanat a vu le jour dans la loi n° 27/2018 du 11 juin 2019 portant orientation de la politique nationale de l’Artisanat en République Gabonaise (article 12). Cette création nouvelle impose une réorganisation de l’actuelle Chambre de Commerce. Toutefois, il est à souligner que l’élection des membres de la Chambre des Métiers de l’Artisanat a eu lieu en 2022.
Cependant, des tentatives d’organisation des élections à la Chambre de Commerce, d’Agriculture, d’Industrie, des Mines et de l’Artisanat du Gabon ont été amorcées par les gouvernants de l’époque avec l’édiction de l’arrêté n° 0271/PM du 03 mai 2021, malheureusement frappé d’inexistence, car pris en violation des dispositions du décret n° 0728 du 21 juin 2011 précité ; puis l’arrêté n° 000196/MCPME du 10 juin 2022, mais le Ministre du Commerce n’avait pas la tutelle de la Chambre de Commerce, plutôt le Ministre de l’Economie. Et curieusement, ce constat de carence ne fut guère relevé par la plateforme des organisations syndicales patronales.
L’acharnement contre les Autorités de la Transition étonne. Le sursis de neuf (9) ans dont ont bénéficié les gouvernements du régime déchu n’est pas accordé au Gouvernement de la Transition qui n’a que cinq (5) mois d’existence. Les observateurs avisés concluent malheureusement à une cabale orchestrée contre le Premier Ministre et surtout son Directeur de Cabinet qui n’exerce pas la tutelle de la Chambre de Commerce.
Pour la gouverne de tous, un projet de décret portant réorganisation de la Chambre de Commerce, désormais sans le pan « Artisanat » avait été proposé, avril 2023, par les services du Premier Ministre au Ministre de l’Economie et à la Chambre de Commerce pour régler définitivement la question électorale. J’ajoute que les opérateurs économiques devaient nourrir cette mouture de leurs observations qui ne sont pas toujours faites (les contributions de la plateforme des organisations patronales sont attendues, à bien des égards. Mais ce projet de texte est actuellement en discussion dans services techniques du Ministère de l’Economie.
Conclusion :
En conclusion, je conseillerai comme dit l’adage : “La patience est la vertu des mendiants.”
