Gabin Otha Ndoumba, ex directeur général des Impôts.
Il était, ces dernières semaines, en résidence surveillée, Gabin Otha a été placé hier, jeudi 19 octobre, sous mandat de dépôt par un juge d’instruction du tribunal spécial de Libreville. L’ex directeur général des impôts a été écroué à Sans famille pour des chefs d’accusation portant sur des malversations financières et des détournements de fonds publics. Les sources judiciaires proches du dossier évoquent une somme de 500 millions de Fcfa que l’ex DG des Impôts avait sorti des caisses de l’administration qu’il dirigeait pour les remettre à Ian Ngoulou, ex directeur de cabinet de Nourredin Bongo Valentin.
Outre cette affaire, Gabin Otha pourraît aussi répondre des dégrèvements illégaux accordés à des opérateurs économiques. En juillet 2023, le journal La Cigale Enchantée révélait le scandale sur l’accord transactionnel de 4 milliards de Fcfa en faveur de la Compagnie industrielle et commerciale des Mines de Huazhou. Une affaire qui avait fait grand bruit aux impôts au point que de nombreuses voix exigeaient le limogeage d’un Directeur général qui était entrain de faire perdre à l’Etat gabonais des « milliards de Fcfa dans un contexte qui exige la plus grande rigueur et orthodoxie au sein des administrations financières ».
Rappel des faits :
En 2022, La Compagnie industrielle et commerciale des Mines de Huazhou, dont le siège est situé à Kalikak, dans le premier arrondissement de la commune de Libreville, fait l’objet d’un contrôle fiscal qui va aboutir à des rappels de « droits et pénalités d’un montant de 4 milliards 806 millions 104 mille 858 Fcfa. Un montant décomposé tel qui suit : 4 milliards 085 millions 914 mille 366 ( droits simples) et 720 millions 190 mille 492 Fcfa ( intérêts deretard). »
La levée de boucliers aux impôts
Dans un courrier envoyé au cabinet du président de l’ ex président Ali Bongo ainsi qu’ au ministre de l’Economie de l’époque, les agents des impôts vont relever les nombreuses irrégularités contenus dans cet accord transactionnel. Notamment le fait que ledit protocole d’accord n’indiquait pas la période ou les exercices vérifiés. Un manquement grave, qui d’après les agents, devait entrainer la nullité de la procédure. Mieux, l’ex directeur général des impôts avait accordé une transaction touchant les droits en violation de l’article 1104 du Code général des impôts.
L’affaire Gabon Autosur
Et comme si tout cela ne suffisait pas, quelques mois plus tard éclate l’affaire Gabon Autosur. La société française spécialisée dans les contrôles techniques des véhicules avait reçu de l’ex directeur général des Impôts plusieurs dégrèvements permettant à la société de Joseph Tripodi de faire disparaître, comme par magie, des mois de TVA non reversés.
Par exemple, le dégrèvement n° 202207710253 du 7 juillet 2022 d’un montant de 13 millions 662 mille 010 Fcfa qui, à la fin, exonère, totalement, la société Gabon Autosur de reverser la TVA collectée sur le dos des usagers.
Pire, concernant le dégrèvement n° 202207710252, Gabin Otha accordait une remise de plus de 80 % sur la TVA collectée par l’entreprise. Ainsi, sur les 11 millions 963 mille 173 Fcfa de TVA collectés, le Directeur général des Impôts autorisait Gabon Autosur à conserver 9 millions 066 mille 712 Fcfa.
Gabin Otha doit désormais répondre de ses actes.
